Here you can find guidelines describing what to do if you need to use your travel insurance and the conditions applying to the travel insurance. You can download a claim form from our website www.gouda.dk.

It is your responsibility to ensure that the policy is correct. We therefore recommend that you check your policy carefully before travelling to ensure that names, the scope of cover, territory covered, type of cover and any supplementary and excluded covers are correct. We also recommend that you leave a copy of the policy (including policy number) with your family or friends in Denmark. If you have any questions, you are welcome to contact us. Enjoy your trip!

I - PLEASE NOTE

• That you must be eligible for benefits under the Danish Health Act (Sundhedsloven), including the public tourist health insurance.

• That special rules apply to persons with chronic/pre-existing ailments.

• That special rules apply if you have reached the age of 70 at the time of departure. If you are travelling outside the EU/EEA, cover is conditional on application for and receipt of an advance approval prior to each individual trip. Consequently, you must complete a health declaration and submit it to Gouda.

• That the travel insurance does not provide cover for claims arising from skiing, unless you have taken out Supplementary Ski Cover. Irrespective of whether you have taken out Supplementary Ski and Accident Cover, the travel insurance does not cover claims under cover 20 Accidents arising from the exercise of any kind of skiing (including snowboarding and ski jumping).

• That the insurance exclusively covers holiday trips of up to one month’s duration.

• That travel insurance can be taken out for the EU/EEA, Extended Europe and Worldwide. Your policy states the territory covered by the travel insurance. The travel insurance does not provide cover in Denmark.

• That the travel insurance may be taken out for Individuals or for the Entire Household. If the travel insurance is taken out for a household, it covers the policyholder and his or her household, including spouse/cohabiting partner and children living at home. The said persons must be registered in the National Register of Persons (Folkeregisteret) as living with the policyholder. Moreover, your own children travelling with you are covered until they reach the age of 18. If the insurance is taken out for one individual only, the conditions apply to that person exclusively.

• That you are responsible for ensuring that the information in your policy is correct.

• That you are responsible for acquainting yourself with the conditions contained in this leaflet which form the basis of any compensation payable by Gouda.

• That you should leave a copy of your policy with a relative in Denmark.

II - ”WHAT TO DO IF…” – WHEN YOU NEED TO USE YOUR TRAVEL INSURANCE

This section forms an integral part of the insurance conditions. It is important that you follow these guidelines accurately, as this may be of significance for Gouda’s liability to pay compensation.

How do I report a claim?
You can use the Gouda Alarm Centre in Copenhagen from anywhere in the world. The alarm centre is open 24 hours a day, 365 days a year. See contact information in section V.

At Gouda Alarm Centre, you will talk to a staff member, who can help you. If you are calling about illness or an accident, doctors are ready to take over and consult with the attending physician. It is important that you follow the instructions given by Gouda’s doctor or the Gouda Alarm Centre.

Before you call Gouda Alarm Centre, you should spend a few minutes getting all the relevant information ready, such as policy number, civil registry number, name and telephone number of doctor/hospital at the destination, diagnosis, name of your own doctor and the address of relatives, if applicable. This will enable us to help you even faster.

Reporting a claim after returning to Denmark
You can report a claim by submitting a claim form to Gouda. Claim forms can be downloaded from our website www.gouda.dk under the link »download form«. The claim form must be submitted to:

If you fall ill, are burgled or…
This section explains what to do if you need to use your travel insurance. Remember that the information provided below should always be related to the insurance conditions (see section III).

Assault
If you are assaulted, you must inform Gouda Alarm Centre as soon as possible. Please note that in order to obtain cover, you must report the assault to the local police as quickly as possible and obtain a medical certificate/emergency department report.

Catching up with itinerary
In cases involving catching up with itinerary, you must contact Gouda Alarm Centre as quickly as possible.

Curtailment
If wish to make an unscheduled early return as a result of sudden serious illness or death of a close relative, you must contact Gouda Alarm Centre immediately. Gouda Alarm Centre will then assess whether there is basis for covering the return trip. If so, Gouda Alarm Centre will arrange an extraordinary return trip. If – subject to agreement with Gouda Alarm Centre – you arrange the return trip yourself or have other outlays covered under the insurance, you should submit a claim form as soon as possible.

Delayed return journey
If your return journey is delayed more than 5 hours you have to forward documentation from the transport company. Furthermore you have to forward original receipt for your reasonable and necessary extra expenses for accommodation and meals.

Emergency department calls
If you need to go to the emergency department, you must contact Gouda Alarm Centre as quickly as possible. As regards payment, you can ask the emergency department to contact Gouda or pay for the treatment yourself and subsequently submit the claim form and original vouchers to Gouda for reimbursement. In either case, you must submit the claim form as soon as possible. Remember to ask for the necessary evidence of your illness, i.e. a medical certificate specifying the diagnosis and any prescribed medication as well as original vouchers for payment of medical treatment and medication. In connection with hospitalisation – please see above.

Emergency reunion and escort
If you need emergency reunion or escort, you must contact Gouda Alarm Centre immediately. In order to make a decision, it is important that you obtain the exact diagnosis from the attending physician, and that Gouda’s doctor obtains access to all relevant medical records.

Evacuation
If you are staying in an area that has to be evacuated, you must contact Gouda Alarm Centre, which will handle the evacuation in collaboration with the public authorities as necessary. You are also welcome to contact Gouda Alarm Centre if you are in doubt about whether evacuation is necessary.

Excess in connection with motor vehicle hire
You must submit a police report or other proof that the claim has been reported, original receipts, loss assessment from the vehicle hire firm’s insurers and other information that may shed light on the case.

Holiday compensation
If you are claiming holiday compensation as a result of illness, injury or curtailment, you must obtain documentation of the duration and nature of the illness from the attending physician. Once you have returned, you must submit a claim form to Gouda together with an original medical certificate and evidence of the price of the trip.

Home transport of own car
If you cannot drive home in your own car because you and all passengers in the car have to cut the trip short, you must contact Gouda Alarm Centre as soon as possible. The Alarm Centre will arrange for home transport of your car.

Hospitalisation
If you are hospitalised you must contact Gouda Alarm Centre as quickly as possible and no later than 24 hours after hospitalisation. Gouda Alarm Centre will ensure that you receive correct and decent treatment. If necessary, Gouda Alarm Centre will furnish a payment guarantee to the hospital concerned. In case of emergency department calls, see below.

Illness or injury
It is a condition for Gouda’s liability to pay compensation that you obtain the exact diagnosis from the attending physician and that you give Gouda’s doctor access to all relevant medical records. Once you have returned home, you must submit vouchers incidental to the expenses, after which you will be reimbursed. Further details about what to do in connection with hospitalisation, visits to the doctor or emergency department calls are given above. You must contact Gouda Alarm Centre if the price of the treatment is expected to exceed DKK 5,000.

Legal assistance abroad
You must contact Gouda immediately if you need legal assistance or provision of security. Any security provided must be repaid to Gouda after your release. Cases involving the provision of security will typically be closed after your return home.

Luggage delay
If your luggage is delayed, you should report the delay to the airline and make sure that you are issued with written confirmation in the form of a PIR (Property Irregularity Report). Moreover, you must also keep the receipts relating to any replacement purchases made at the destination and, if possible, ask for evidence of the time when you will receive your luggage from the airline. Finally, you must submit a claim form to Gouda together with the above-mentioned original vouchers, original plane tickets and luggage tags once you have returned home.

Medical treatment
If you have been treated by a GP, you can ask the doctor to contact Gouda concerning payment, or you can pay for the treatment yourself and subsequently send the claim form and original vouchers to Gouda for reimbursement. In either case, you must submit the claim form as soon as possible. In any case, remember to ask for the required evidence of your illness; that is, a medical certificate specifying the diagnosis and any prescribed medication as well as original vouchers for payment of medical treatment and medication. If the expected price of the treatment exceeds DKK 5,000, Gouda Alarm Centre must be contacted.

Missed departure
If you miss the planned means of transport, you must contact Gouda Alarm Centre stating where you bought the ticket. In collaboration with the travel agency/airline, Gouda Alarm Centre will then advise you and help you find alternative transport.

Personal liability
Never accept any liability yourself. Leave this decision to Gouda. Otherwise you may risk having to pay compensation, including for claims, for which you cannot be made liable. You must contact Gouda as quickly as possible if you find yourself in a situation deemed to result in a claim for compensation against you. It is important that you notify Gouda of the names and addresses of the injured party and any witnesses.

Personal possessions
In the event of theft, loss of or damage to personal possessions, it is a condition for Gouda’s liability to pay compensation that you report the incident to the local police as quickly as possible. If the damage or loss took place while the luggage was in the carrier’s/airline’s care, you must report the loss as quickly as possible to the said company and be issued with a PIR (Property Irregularity Report) as evidence that the damage or loss was reported. The claim form must be submitted to Gouda as quickly as possible. Please enclose original evidence of reporting the incident to the above authorities and original evidence of the value and age of the stolen, lost or damaged possessions. In the event of damage to personal possessions, the damaged possessions may not be thrown out until permission to do so has been given or the loss has been calculated. The damaged possessions must be submitted to Gouda on demand. Unretrieved checked-in luggage will not be considered lost until at least 30 days after you arrived at the destination.

Rented holiday accommodation protection
If your holiday accommodation becomes uninhabitable as a result of theft, water damage, fire, explosion, flooding, earthquake or other natural disaster, you must contact Gouda Alarm Centre. The alarm centre will help you find similar holiday accommodation together with you or your travel agency.

Repatriation
In all cases that may involve repatriation, you must contact Gouda Alarm Centre as quickly as possible. In consultation with the attending physician/hospital, Gouda’s doctor will assess whether repatriation is necessary and safe.

Replacement car prior to departure
If your car is damaged to such a degree that a planned self-drive holiday cannot be commenced, you must contact Gouda Alarm Centre as quickly as possible. The alarm centre will help you rent a replacement car.

Search and rescue
If a search or rescue operation is required, the local authorities should be contacted first, after which Gouda Alarm Centre should be contacted as quickly as possible. Gouda Alarm Centre will take the necessary steps in collaboration with the local and public authorities as necessary.

Travel documents
It is a condition for Gouda’s liability to pay compensation in connection with theft, robbery, etc., that you immediately report the incident to the local police. If the loss results in problems that require immediate attention, you must immediately contact Gouda Alarm Centre. After returning home, you must submit the claim form to Gouda as soon as possible. Please submit the original evidence substantiating that the incident has been reported to the police authority together with the claim form and original evidence of expenses for obtaining new travel documents, transport, charges and photo.

III – INSURANCE CONDITIONS

This section specifies the detailed conditions that apply to the travel insurance; that is, its scope and exclusions. These conditions provide the basis of the cover provided. Please note that sections I and II constitute an integral part of the conditions and that any instructions contained therein must be followed. Clause 37 provides a definition of the words given in italics.

If an expense is not included in the description of the cover (Expenses covered by the travel insurance), it is not covered by your travel insurance


1 MEDICAL EMERGENCY 

For travel in the EU/EEA, only clauses 1.1 g and 1.1 l apply, because you are covered under the public tourist health insurance.

 Sum insured Unlimited 


In the event of sudden illness or injury arising while travelling, the travel insurance covers reasonable and necessary expenses for
a) treatment by a doctor authorised to practice in the country in which you are treated (attending physician),

b) medication – prescribed by the attending physician or Gouda’s doctor,

c) hospitalisation in a two-bed ward (semi-private) and hospital treatment, including surgery, prescribed by a doctor,

d) delivery of screened blood and on-site monitoring to ensure that you receive the screened blood. It is a condition for cover that Gouda’s doctor is of the opinion that you are staying in a risk area,

e) pregnancy complications, childbirth, treatment of an unborn or premature child up to eight weeks before the expected date of delivery. Such expenses are covered under the mother’s travel insurance. The expenses incidental to treating an unborn or premature child must be covered by this medical emergency cover, and the travel insurance exclusively provides cover for up to one month’s treatment,

f) telephone calls during hospitalisation by up to DKK 1,000,

g) transport by taxi to and from the treatment facility by up to DKK 1,000,

h) transport by ambulance from the place of illness/accident to the treatment facility. Air ambulance is subject to Gouda’s prior approval,

i) ambulance transport following failed treatment to the nearest appropriate treatment facility. It is condition that Gouda’s doctor – after contact with the attending physician – finds that such ambulance transport is a necessary and safe,

j) extension of your Gouda travel insurance in cases where your return trip is delayed beyond the period of cover.

The travel insurance also covers reasonable and necessary additional expenses incidental to

k) hotel accommodation and meals up to a maximum of DKK 1,500 per day, provided Gouda’s doctor is of the opinion that you can be treated as an out- rather than an in-patient,

l) hotel accommodation and meals up to a maximum of DKK 1,500 per day after completion of your treatment while awaiting repatriation or catching up with your itinerary.

1.2 The travel insurance does not cover
The travel insurance does not cover expenses

a) for treatment or accommodation after your return to Denmark,
b) for assessment/treatment of conditions/illnesses, protheses and cosmetic procedures within the last two months prior to departure that has resulted in:

• hospitalisation,
• assessment/treatment by a doctor or another therapist that is not part of a check-up,
• change in medication, including gradual reduction,

c) for treatment of chronic or pre-existing illnesses if:
• you have not consulted a doctor or have refused/discontinued treatment for such illness even though you should have realised or assumed that the illness required treatment or had aggravated materially,
• treatment has been given up or refused,
• you have been signed up for, referred to or are on a waiting list for assessment/treatment,
• you have missed agreed check-ups within the past two months or normal check-ups have been discontinued due to non-attendance for previous check-ups,

d) for treatment of illnesses, which are or have been in the process of being clarified prior to departure, even if no diagnosis was made,

e) for check-up and treatment, including medication, needed to regulate and keep a chronic or pre-existing illness stable,

f) for a treatment need known prior to departure,

g) for continued treatment or accommodation if you refuse to be repatriated when repatriation has been decided by Gouda’s doctor,

h) for treatment or accommodation if Gouda’s doctor has decided that treatment can await your return to Denmark,

i) for repatriation organised by yourself which Gouda would not have incurred if Gouda had arranged it,

j) for transport due to your fear of infection,

k) incurred because of your failure to follow the instructions of Gouda’s doctor,

l) for dental treatment – see cover 4 Dental treatment and physiotherapy, etc.

m) for physiotherapy, chiropractor or other non-medical treatment – see cover 4 Dental treatment and physiotherapy, etc.

n) for induced abortion,

o) for treatment of or complications of aids, including examination of symptoms. This exclusion applies irrespective of clause 1.2 a-c,

p) for replacing, renewing or repairing artificial limbs, glasses, contact lenses, hearing aids, dentures, or other aids,

q) for stays at recreational centres or health resorts.

r) for treatment or hospitalisation following expiry of your policy. In case Gouda´s physician assess that you are unable to proceed with your return journey due to a covered incident, the policy provides cover for treatment and hospitalisation until you are able to return to Denmark.

2. REPATRIATION

For travel in the EU/EEA, clauses 2.1 b and c do not apply, because you are covered by the public tourist health insurance.

2.1 Expenses covered by the travel insurance
In the event of sudden illness or injury comprised by cover 1 Medical emergency or the public tourist health insurance, the travel insurance covers reasonable and necessary

a) additional expenses for repatriation to your home/a hospital in Denmark. After consultation with the attending physician, Gouda’s doctor will assess whether repatriation is necessary and safe and, if so, what means of transport should be used. Gouda decides when repatriation will take place,

b) expenses for repatriation to undertaker/crematorium in Denmark in connection with death including expenses for statutory arrangements such as embalming and zinc coffin or

c) expenses for cremation and/or funeral on site if desired by the relatives. The maximum cover under the travel insurance amounts to repatriation expenses,

d) additionalexpenses for returning personal possessions that you have to leave behind as a result of repatriation approved by Gouda,

e) expenses for taxi or ambulance transport prescribed by the doctor from the hospital or airport to your home after you have been repatriated to Denmark by Gouda,

If, after completion of treatment and discharge from a hospital abroad, you have been unable to follow the itinerary planned and documented prior to departure and you have not been repatriated at Gouda’s expense, the travel insurance covers reasonable and necessary additional expenses for

f) catching up with your itinerary – economy class as a maximum – to the destination where you would have been by this stage according to you itinerary or

g) returning to your home in Denmark – economy class as a maximum. In connection with returning to your home in Denmark, you are not entitled to a return trip to the destination.

2.2 The travel insurance does not cover
The travel insurance does not cover expenses for

a) repatriation due to chronic or pre-existing illnesses that within the last two months prior to departure have resulted in

• hospitalisation,
• assessment/treatment by a doctor that is not part of a check-up,
• change in medication,

b) repatriation in connection with chronic or pre-existing illnesses if:

• you have not consulted a doctor or have refused/discontinued treatment for the illness even though you should have realised or assumed that the illness required treatment or had aggravated materially,
• treatment has been given up or refused,
• you have been signed up for, referred to or are on a waiting list for assessment/treatment,
• you have missed agreed check-ups within the past two months or normal check-ups have been discontinued due to non-attendance for previous check-ups,
c) repatriation organised by yourself which Gouda would not have incurred if Gouda had arranged the transport,
d) air ambulance in cases where, in the opinion of Gouda’s doctor, transport by other means is medically justifiable,
e) repatriation due to your fear of infection.

 

3 ASSISTANCE ABROAD – 24-HOUR MEDICAL TREATMENT

3.1 Expenses covered by the travel insurance
While travelling, you have access toGouda’s 24-hour Danish medical emergency service in the event of minor and serious illness, as well as advice and guidance about medical treatment, medication prescribed by the attending physician and about suitable doctors and dentists abroad.

3.2 The travel insurance does not cover
The travel insurance does not cover your expenses connected with contacting Gouda’s 24-hour medical emergency service.

 

 4 DENTIST AND PHYSIOTHERAPY, ETC.

4.1 Expenses covered by the travel insurance
In the event of sudden illness or injury covered under the public tourist health insurance, cover 1 Medical emergency, or in connection with sudden toothache/dental injury, the travel insurance covers reasonable and necessary expenses for
a) treatment prescribed by the doctor with an authorised physiotherapist, chiropractor or other non-medical practitioner,
b) urgent and sudden dental treatment.

4.2 Limit of cover
Cover under clause 4.1 a is limited to a maximum of 15 treatments.

4.3 The travel insurance does not cover
The travel insurance does not cover expenses for
a) treatment after your return to Denmark,
b) treatment or accommodation after the time at which you refuse to be repatriated when repatriation has been decided by Gouda’s doctor,
c) treatment or accommodation in cases where Gouda’s doctor has decided that treatment can await your return to Denmark,
d) dental treatment, if you have not followed a normal regime of dental care, including at least one annual check-up and any required treatment,
e) the replacement, repair or renewal of dentures.

5 PERSONAL SAFETY

5.1 EMERGENCY COUNSELLING ON SITE

5.1.1Expenses covered by the travel insurance

The travel insurance covers your expenses for emergency counselling at the site of the incident if you have been involved in

a) a major accident,
b) a severe traumatic event involving several persons,
c) a natural disaster,
d) a act of terrorism, war or warlike condition,
e) a hostage taking.

It is a condition for cover that Gouda’s doctor or psychologist finds that emergency counselling is necessary.

5.2 TELEPHONE EMERGENCY COUNSELLING FOR RELATIVES

 Sum insured  Unlimited


5.2.1Expenses covered by the travel insurance
The travel insurance covers expenses for emergency counselling by telephone for your relatives if you are entitled to emergency counselling under cover 5.1 Emergency counselling on site.

If is a condition for cover that Gouda’s doctor or psychologist assesses that emergency counselling for your relatives is necessary.

5.3 EMERGENCY COUNSELLING AFTER YOUR RETURN

5.3.1Expenses covered by the travel insurance
The travel insurance covers your expenses for psychological counselling after your return when you have been exposed to

a) a natural disaster,
b) an act of terrorism, war or warlike condition,
c) a hostage taking,
d) a life-threatening epidemic.

To be covered, your GP must refer you to treatment by a psychologist.

5.4 EVACUATION

Transport expenses  DKK 50,000 kr.
Additional expenses  DKK 15,000 kr.


5.4.1 Expenses covered by the travel insurance
The travel insurance covers reasonable and necessary expenses for transport, hotel accommodation, clothes and local transport in connection with evacuation to the nearest safe destination or to Denmark. The travel insurance provides cover in the event that

a) the Ministry of Foreign Affairs recommends evacuation or returning home due to war or warlike conditions or imminent danger of outbreak of war or warlike conditions in the country in which you are staying,

b) the Ministry of Foreign Affairs recommends evacuation or returning home due to an act of terrorism or imminent danger of an act of terrorism,

c) the Ministry of Foreign Affairs or local authorities recommend evacuation or returning home due to a natural disaster or imminent danger of a natural disaster in the area in which you are staying,

d) Statens Serum Institut recommends evacuation or returning home due to life-threatening epidemics in the area in which you are staying.

Gouda bases it decision about whether to provide cover for evacuation and, if cover is provided, about the location of the nearest safe destination, on the recommendations issued by the Ministry of Foreign Affairs, Statens Serum Institut and local authorities.

5.4.2 Limit of cover
Evacuation must take place at the earliest possible opportunity. If, at this time, you do not wish to accept the offer for evacuation, cover ceases.

5.4.3 The travel insurance does not cover
The travel insurance does not provide cover if, at the time you enter an area, the Ministry of Foreign Affairs, Statens Serum Institut or local authorities have recommended or carried out evacuation.

5.5 SEARCH AND RESCUE

5.5.1 Expenses covered by the travel insurance
The travel insurance covers necessary expenses for search and/or rescue.
It is a condition for cover that

a) the incident has been reported to the local police/local authorities and that they or the Ministry of Foreign Affairs initiated the search/rescue, and that

b) Gouda Alarm Centre is contacted as quickly as possible if search or rescue becomes necessary and that the alarm centre approves the companies to manage the search and its scope.

5.5.2 Limit of cover
a) Irrespective of the number of insurances taken out and policyholders, the maximum compensation payable per insurance event is limited to DKK 300,000.

b) It is a condition for cover that the missing person is insured with Gouda. If several persons are missing as a group, search expenses are distributed evenly among the number of missing persons.

c) A request from your family to establish contact with you – for whatever reason – is not considered a search if you have failed to inform your relatives of your location or itinerary.

d) Under this clause, a 10% excess, or at least DKK 2,500, applies to all claims.

5.5.3 The travel insurance does not cover
The travel insurance does not cover

a) remuneration to organisations/authorities normally carrying out search operations on a voluntary/cost-free basis,

b) search operations above 75° north latitude or on the South Pole,

c) the need for a search because of gross negligence displayed by you,

d) the search for an insured person suffering from pre-existing mental disorder assumed to be the reason for the disappearance,

e) the search for an insured person diagnosed with a terminal illness,

f) the search for persons disappearing during performance of professional sports or training or while on a scientific expedition,

g) expenses for search/rescue in the event of kidnapping or capture.

5.6 TERRORIST ACTS

5.6.1 Expenses covered by the travel insurance
a) If you are a direct victim of an act of terrorism resulting in personal injury, the travel insurance covers necessary additional expenses for earlier return trip/repatriation to Denmark, including by air ambulance, if necessary. It is a prerequisite that Gouda’s doctor judges that repatriation is necessary and that the transport has been arranged according to agreement with Gouda.

b) If, within a radius of 5 km from the place at which you are staying, you are indirectly the victim of an act of terrorism in the form of a bomb explosion, chemical or biological warfare, hijacking or other form of terrorist act resulting in personal injury to others than yourself, the travel insurance covers necessary additional expenses for earlier return to your home. The travel insurance covers up to half the amount you originally paid for transport.

5.6.2 Limit of cover
It is a condition for cover that earlier return to your home/repatriation results in arrival in Denmark earlier than 72 hours before the originally scheduled arrival time.

5.6.3 The travel insurance does not cover
Repatriation initiated by the travel provider or others, including public authorities, is not encompassed by the travel insurance

5.7 HOSTAGE-TAKING

5.7.1 Expenses covered by the travel insurance
If you have been held hostage, the travel insurance covers

a) necessary additional expenses for repatriation to Denmark, including by air ambulance, if necessary, on the condition that Gouda’s doctor finds repatriation necessary and the transport is arranged according to agreement with Gouda,

b) additional expenses for accommodation at a hotel, local transport and meals.

c) extension of the period of insurance in cases where the period of insurance expires while you are held hostage. The extension takes effect on expiry of the current period of insurance and remains in effect until your return to Denmark – but for no longer than 14 days after you have been released.

5.7.2 The travel insurance does not cover
The travel insurance does not cover

a) expenses for investigating the hostage-taking,

b) ransom expenses,

c) any claim arising as a result of events occurring in areas of war, during warlike conditions, riot or civil commotion.

5.8 DETENTION DURING TIMES OF WAR

If you are detained by the authorities in a country due to war or risk of war, the travel insurance covers necessary additional expenses for

a) accommodation and domestic transport,
b) meals by up to DKK 500 per day.

Cover ends three months after the first time you were detained.

6 MEDICAL MALPRACTICE

6.1 Expenses covered by the travel insurance
The travel insurance covers permanent injury as a result of proven medical malpractice directly related to a claim covered under the insurance pursuant to cover 1 Medical emergency or comprised by the public tourist health insurance. The liability to pay compensation is determined according to sections 20-23 of the Danish Act on the Right to Complain and Receive Compensation in the Health Service (Lov om klage- og erstatningsadgang inden for sundhedsvæsenet), and the amount of compensation is determined according to the Danish Liability for Damages Act (Lov om erstatningsansvar).

The sums insured represent the maximum limit of Gouda liability to pay compensation per insurance event even if several parties covered under one or more policies with Gouda are held liable.

7.1 Types of claims covered by the travel insurance
The travel insurance provides cover if, pursuant to applicable law in the country in which the damage/injury takes place, you are held liable for injury to persons or damage to property according to the general rules on non-contractual liability. Moreover, the travel insurance covers damage to rented holiday accommodation/hotel, see clause 7.2 c.

7.2 Expenses covered by the travel insurance
The travel insurance covers

a) the sum that the authorities in the country in which you are staying have instructed you to pay,
b) expenses incidental to settling the liability issue if approved in advance by Gouda,
c) damage to rented holiday and/or hotel accommodation and furnishings, subject to a DKK 1,000 excess per insurance event. It is a condition that the damaged property was in your custody.

7.3 Limit of cover
You must never accept any liability yourself or approve a claim for compensation. It must always be left to Gouda to make such a decision. Otherwise, you may risk having to pay compensation, including for claims for which you cannot be held liable. You must contact Gouda as quickly as possible about the loss occurrence. Gouda will then decide how to proceed with the matter.

7.4 The travel insurance does not cover
The travel insurance does not cover your liability

a) originating from employment- or business-related matters,
b) for damage to or loss of your own property,
c) for claims as a result of your assumption by agreement or otherwise of more extensive liability than the liability that applies according to the general rules on non-contractual liability,
d) for damage to property that you have borrowed or rented or have in your possession for storage, use, transport, processing or otherwise – except as set out in clause 7.2 c,
e) for injury attributable to your transmitting a disease to others by infecting them or otherwise,
f) for damage or injury caused by the use of a motor vehicle, caravan or trailer, aircraft or vessel with an engine power exceeding 10 hp or any vessel being more than 5 metres long.
g) for injury caused to family or travel companion,
h) for damage or injury caused by animals,
i) for damage or injury caused by the use of firearms.

8 LEGAL ASSISTANCE ABROAD

The travel insurance covers reasonable and necessary

a) legal expenses when a dispute arising during the trip or at the destination requires legal assistance,

b) legal expenses in connection with criminal lawsuits. If you are found guilty of a criminal offence by a court of first instance, expenses already paid are considered a loan to be repaid to Gouda on demand. Interest is payable on the loan at the discount rate of Danmarks Nationalbank with the addition of 4%.

c) travel expenses resulting from your being called as a witness or called for examination by a foreign court.

d) expenses for the provision of security required for your release or release of your possessions from foreign authority detention. The provision of security is considered an interest-free loan repayable to Gouda after release or on demand.

8.2 It is a condition for cover
It is a condition for cover

a) that the matter on which the dispute or criminal lawsuit is based occurred during the period of insurance and concerns matters arising in the course of the trip,

b) that you are directly involved in the dispute or the criminal lawsuit,

c) that the dispute cannot be processed administratively or brought before a complaints board or the like.

8.3 Excess
a) A 10% excess of the total expenses covered under the insurance applies to any claim under clauses 8.1 a and c – but no less than DKK 2,500.

b) A 20% excess of the total expenses covered under the insurance applies to any claim under clause 8.1 b – but no less than DKK 5,000.

8.4 The travel insurance does not cover
The travel insurance does not cover
a) expenses incurred for no good reason, for example, if you are deemed to have no reasonable cause to conduct the case or because the associated expenses are disproportionate to the subject-matter of the case,

b) disputes between you and the travel agency/provider/organizer, airline or one or more of your travel companions,

c) disputes between you and Gouda,

d) disputes in connection with contractual, business- or employment-related matters,

e) disputes in connection with family, social-security, pension or inheritance law matters,

f) expenses relating to traffic offences involving a motorized vehicle used by you,

g) genuine compensation or penalty-like claims.

9 CURTAILMENT

9.1 Expenses covered by the travel insurance
The travel insurance covers reasonable and necessary extra transport expenses – economy class as a maximum - for you and one travel companion, in the event that you

a) have to make an unscheduled return journey to Denmark due to serious sudden illness/injury resulting in hospitalisation or death of your spouse or cohabiting partner, children, stepchildren, foster children, parents, stepparents, foster parents, grandparents, brothers, sisters, stepbrothers/-sisters, parents-in-law, sons-/daughters-in-law and brothers-/sisters-in-law,

b) are notified of material damage resulting from fire, flooding or burglary in your private dwelling in Denmark or in our own company, or in the event of unofficial strikes or fraudulent acts in your own company and the incident requires your personal and immediate presence.

9.2 Limit of cover
a) It is a condition for Gouda’s liability to pay compensation that curtailment has been agreed with Gouda.

b) The travel insurance exclusively provides cover for one unscheduled return journey per period of insurance to the person giving rise to the curtailment.

9.3 The travel insurance does not cover
The travel insurance does not cover

a) curtailment if your due return time is less than 12 hours prior to the time originally scheduled for your return,

b) cases where the family member giving rise to the curtailment was travelling with you and has been repatriated under cover 2 Repatriation.

10 EMERGENCY REUNION AND ESCORT

EMERGENCY REUNION
10.1 Types of claims covered by the travel insurance

The travel insurance provides cover in the event that you are

a) affected by sudden illness or suffer injury encompassed by the public tourist health insurance or cover 1 Medical emergency, which in the opinion of the attending physician and Gouda’s doctor is expected to lead to hospitalisation for at least two days after the visitor to bedside arrives at the treatment facility,

b) affected by or suffer a sudden life-threatening illness or injury encompassed by the public tourist health insurance or cover 1 Medical emergency.

10.2 Expenses covered by the travel insurance
The travel insurance covers the expenses incurred by the visitor to bedside for
a) transport from his or her residence in Denmark and back – economy class as a maximum,

b) transport in the event that you have to be transferred to another treatment facility or repatriated, using the same transport class as you as a maximum, but see clause 10.6 a,

c) taking out a Gouda travel insurance of the same type as the one you have taken out for the duration of the escort. It is a condition that the visitor to bedside fulfils the criteria for taking out a Gouda travel insurance,

d) hospital or hotel accommodation up to a maximum of DKK 1,500 per person per day,

e) documented meal and local transport expenses up to a maximum of DKK 250 per person per day.

10.3 The travel insurance does not cover
The travel insurance does not cover

a) emergency reunion if you are to be repatriated within two days of the visitor’s arrival at the treatment facility.

b) expenses for emergency reunion arranged by yourself or the visitor to bedside which Gouda would not have incurred, had Gouda arranged the emergency reunion.

ESCORT
10.4 Types of claims covered by the travel insurance
The travel insurance provides cover in the event that you

a) are affected by a sudden illness or suffers injury encompassed by the public tourist health insurance or cover 1 Medical emergency, which in the opinion of the attending physician and Gouda’s doctor is expected to lead to hospitalisation for at least two days,

b) are affected by or suffer a sudden life-threatening illness or injury encompassed by the public tourist health insurance or cover 1 Medical emergency,

c) need to be repatriated as a result of illness, injury or death.

10.5 Expenses covered by the travel insurance
The travel insurance covers the escort’s necessary additional expenses for

a) transport using the same transport class as you as a maximum in the event that you have to be transported to a suitable treatment facility or repatriated, but see clause 10.6 a,

b) transport to your residence or for catching up with itinerary, economy class as a maximum, once escorting is completed on your discharge from hospital at the destination. In the event of repatriation, escorting is not completed until your arrival at your residence/a hospital in Denmark,

c) extension of existing travel insurance with Gouda or taking out a Gouda travel insurance of the same type as that of the insured for the duration of the escort. It is a condition that the escort fulfils the criteria for taking out a Gouda travel insurance,

d) hospital or hotel accommodation up to a maximum of DKK 1,500 per person per day,

e) documented meal and local transport expenses up to a maximum of DKK 250 per person per day.

10.6 Limit of cover
a) In the event that you are repatriated on a better transport class than economy class, the travel insurance covers a maximum of one visitor to bedside/escort on the same transport class. In the event that you are repatriated with medical escort (doctor or nurse), including air ambulance, any visitors to bedside/escorts are not entitled to transport on the same transport class as you.

b) Cover of accommodation and meal expenses for visitor to bedside and escort ceases once escorting has been completed on discharge from hospital at the destination or your arrival at your residence/a hospital in Denmark.

c) Cover of accommodation and meal expenses for visitor to bedside and escort ceases once escorting has been completed on discharge from hospital at the destination. In the event of repatriation, escorting ceases on your arrival at your residence/a hospital in Denmark.

11 MISSED DEPARTURE

11.1 Types of claims covered by the travel insurance
In the event that you have to catch up with your itinerary because you

a) arrive late for a means of public transport or a means of transport organised by the travel provider through no fault of your own and without being able to foresee or remedy it or

b) suffer an insurance event covered under cover 16 Travel documents, and you need to replace air tickets, passport or visas.

11.2 Expenses covered by the travel insurance
The travel insurance covers reasonable and necessary additional expenses for

a) transport to catch up with itinerary – on the same class as the original outward journey as a maximum,

b) hotel accommodation – DKK 1,000 per day as a maximum,

c) meals and local transport – up to a maximum of DKK 250 per day.

11.3 Special conditions
It is a condition for cover that ticket(s) have been booked and paid for 24 hours before departure.

11.4 The travel insurance does not cover
The travel insurance does not cover

a) missed departure in connection with connecting flights where the official minimum transfer time has not been observed (minimum connecting time),

b) missed departure in connection with the outward journey up to 24 hours after departure, if the travel insurance was not taken out until the departure date.

12 HOLIDAY ACCOMMODATION COVER

12.1 Types of claims covered by the travel insurance
The travel insurance provides cover in the event your holiday accommodation abroad is rendered uninhabitable as a result of theft, water damage, fire, explosion, flooding, earthquake or other natural disaster.

12.2 Expenses covered by the travel insurance
The travel insurance covers expenses for renting similar holiday accommodation.

13 EXCESS IN CONNECTION WITH MOTOR VEHICLE HIRE

13.1 Types of claims covered by the travel insurance
The travel insurance provides cover in connection with damage to motor cars, motorbikes or mopeds rented abroad.

13.2 Expenses covered by the travel insurance
The travel insurance covers any expenses for excess payable under the comprehensive motor insurance.

13.3 The travel insurance does not cover
The travel insurance provides no cover

a) if no comprehensive motor insurance has been taken out for the car, motorbike or moped,

b) if, under the laws of the country in which the vehicle was hired, you were not authorised to drive the vehicle.

14 REPLACEMENT CAR PRIOR TO DEPARTURE

14.1 Types of claims covered by the travel insurance
The travel insurance provides cover if you cannot go through with your planned self-drive holiday because of damage to or loss of your car in Denmark covered by an ordinary Danish comprehensive motor insurance.

14.2 Special conditions
The travel insurance covers only damage or loss arising prior to the planned self-drive holiday. If the damage or loss occurs within 12 hours of your departure from your residence, the travel insurance provides cover between your residence and the Danish border.

14.3 Expenses covered by the travel insurance
a) The travel insurance covers expenses for hiring a replacement car in the same category as your own car. However, Gouda is entitled to provide a larger car. The replacement car is hired with unlimited mileage.

b) The travel insurance covers the hire of a car as from two days before the start of the holiday and up to the day after your scheduled return. However, cover ceases on the policy expiry date or after one month, at the latest.

c) The replacement car must be hired with a nationwide car rental company according to Gouda’s instructions. Hire takes place on the contractual terms offered by the car rental company, including third-party liability and comprehensive motor insurance. The hired car must be collected and returned by you at the premises of the car rental company.

14.4 The travel insurance does not cover
The travel insurance does not cover expenses for

a) hiring motorbikes, caravans or trailers, mobile homes, etc.,

b) fuel, oil, windscreen wash, etc.

c) collecting and returning the replacement car.

15 HOME TRANSPORT OF OWN CAR

15.1 Types of claims covered by the travel insurance
The travel insurance provides cover if you and all passengers in the car have to cut your trip short due to curtailment covered under cover 9 Repatriation.

15.2 Expenses covered by the travel insurance
The travel insurance covers reasonable and necessary expenses for transporting the car home.

16 TRAVEL DOCUMENTS

16.1 Types of claims covered by the travel insurance
The travel insurance covers all types of theft and damage to tickets, passport, visas, Dankort (Denmark’s national debit card), Visa/Dankort and credit cards.

16.2 Expenses covered by the travel insurance
The travel insurance covers your additional expenses for

a) obtaining new tickets, passport, visas, Dankort, Visa/Dankort and credit cards,

b) necessary transport, charges and photos.

16.3 The travel insurance does not cover
The travel insurance does not cover

a) items left behind, lost or misplaced,

b) theft of travel documents left behind or not kept under effective surveillance,

c) losses in connection with unauthorised use of credit cards,

d) time spent on replacing the items


17 LUGAGE DELAY

Sum insured DKK 3.000 kr. but a maximum of DKK 1.000 per 24 hour period 

17.1 Expenses covered by the travel insurance
The travel insurance covers reasonable, necessary and documented additional expenses for replacement purchases or replacement hire corresponding to the missing luggage in the event that your checked-in luggage is delayed for more than five hours after your arrival at a destination outside Denmark.

17.2 Special conditions
If you have a contents insurance covering theft/loss of personal items while travelling abroad in the period of insurance stated in your policy and if you have taken out cover 18 Personal possessions, the sums mentioned in clause 17 are doubled.

17.3 Limit of cover
Compensation cannot exceed the sums of clause 17 per delayed luggage item.

17.4 The travel insurance does not cover
The travel insurance does not cover the replacement purchases and/or replacement hire of items made after the luggage has arrived at the destination.

18 HOLIDAY COMPENSATION

18.1 Types of claims covered by the travel insurance
The travel insurance provides cover for claims comprised by the public tourist health insurance scheme, cover 1 Medical emergency, cover 2 Repatriation or cover 9 Curtailment, in the event you

a) are called home,

b) are hospitalised,

c) are repatriated,

d) die,

e) suddenly fall ill/suffer injury and are unable to carry out the activity that was the primary purpose of the trip. The illness/injury must be documented by a local doctor, and the evidence forms the basis of Gouda’s assessment of the extent to which the primary purpose of the travel could not be achieved.

18.2 Expenses covered by the travel insurance
The travel insurance covers the price of the trip per day for days of holiday that cannot be utilised due to one or more of the loss events mentioned in clause 18.1. Holiday compensation is granted at the earliest from the day after you are hospitalised, have to make an unscheduled return journey, are repatriated or see a doctor.

18.3 Persons covered
The following groups of persons are covered:
Claims encompassed by clause 18.1 a-d:

a) The injured person and up to two travel companions stated on the same invoice/travel certificate as the injured person or having purchased the trip in order to travel with the injured person.

b) Parents travelling with their own children who live at home or are under the age of 24. If one or more family members become entitled to compensation, see clause 18.1 a-d, the travel insurance provides cover for the entire family (parents and own children living at home or under the age of 24).

Claims encompassed by clause 18.1 e:
c) The travel insurance only covers the price of the trip per day for the injured person. However, if the injured person is under the age of 16, the travel insurance also covers 50% of the price of the trip per day for one travel companion.

It is a condition for payment of holiday compensation that the travel insurance taken out with Gouda by the individual includes holiday compensation cover. The travel insurance only covers one of the above-mentioned groups of persons.

18.4 Limit of cover
Holiday compensation beyond the period of insurance is not covered.

18.5 Special conditions
a) If adequate evidence from the attending physician confirming that you were unable to carry out the planned activity is not available, Gouda’s doctor will assess whether, based on the diagnosis made, you are entitled to compensation, see clause 18.1 e, and if so, for how many days.

b) Compensation is granted to the persons stated in clause 18.3 for the same period during which compensation is granted to the injured person.

19. DELAYED RETURN JOURNEY

19.1 When does the policy provides cover

In case your home journey to Denmark with public transport is delayed more than 5 hours, the policy provides cover. The delay is calculated in relation to the scheduled time of arrival according to the itinerary issued by the travel agent. Schedule changes have to be announced prior to commencement of the journey. Documentation from the airline company including duration and cause for the delay are to be forwarded.

It is a condition for coverage that the delay is due to climatic circumstances or mechanical errors and that it affects your means of transportation. Furthermore it is a condition that you are not entitled to compensation from elsewhere.

19.2 Costs covered by the travel insurance
The policy covers
a) reasonable and necessary extra expenses for accommodation and meals with DKK 500 per day – maximum DKK 2,500.
b) if necessary, extension of the policy due to a extension of the journey as a result of a delay covered under delayed return journey.

19.3 The policy does not cover
The policy does not provide cover for delays as a result of flights to or from the Faroe Island or Greenland and domestic flights within Greenland.

20. PERSONAL POSSESSIONS (LUGGAGE)

If the policy states that you have taken out Supplementary Cover for Personal Possessions, compensation is granted according to the conditions stated below.

20.1 Types of claims covered by the travel insurance
The travel insurance covers

a) financial loss resulting from all types of theft of and damage to your personal possessions,

b) loss of checked-in luggage,

c) any excess and loss of bonus in connection with a claim covered under the insurance which is also covered by your contents insurance by up to DKK 3,000.

19.2 Limit of cover – applies to all covers under clause 20.1.

a) Compensation for a single item complete with accessory equipment (for example, camera and camera accessories) is provided at a maximum of 50% of the sum insured under clause 19 irrespective of whether or not several covers for the item have been taken out with Gouda.

b) Cash, traveller’s cheques, securities and similar valuables are only covered in the event of theft and only when the items are carried by you or kept in a locked safety box in your room or at the hotel reception. The maximum compensation amounts to:

c) PC including accessories is covered by a maximum of DKK 2,000.

d) Mobile phones including accessories and SIM card, PDAs and GPS equipment, portable music players, including Mp3 players, CDs, DVDs, MiniDiscs and the like corresponds to the sums stated in the table in clause 20.2 b. This applies regardless the single device contains functions other than the primary function.

e) In the event of theft from a locked motor vehicle, boat, camper or caravan, cover is limited to 50% of the applicable sum insured.

f) In the event of theft/loss of bags, suitcases, backpacks or the like, the maximum compensation for one single item like these including contents equals the sum stated in clause 19, irrespective of whether or not the loss is divided among several insured and/or covered by several policies.

g) If travelling by plane, bus or train, PC equipment, PDAs, GPS equipment, jewellery, watches, glasses, sunglasses, diving computers, photographic equipment, video equipment and audio equipment, including portable music players, are covered only if such items are carried as hand luggage.

20.3 The travel insurance does not cover
The travel insurance does not cover

a) tickets, passport, visas, Dankort, Visa/Dankort and credit cards. See clause 12 Travel documents,

b) items left behind, lost or misplaced,

c) TV appliances, artificial limbs/dentures, boats, all kinds of surfing gear and means of transport, including bicycles, and accessories for all these items,

d) theft of luggage not kept under effective surveillance,

e) theft from locked holiday accommodation, hotel room or the like, not showing visible signs of forced break-in,

f) theft, damage or loss of items used for commercial purposes,

g) theft from unlocked holiday accommodation, car, plane, bus, boat, camper, caravan or unoccupied tent,

h) loss of or damage to luggage sent by separate means of transport independent of your trip, but not to shipments as described in clause 2.1 d.

i) damage to luggage owing to inadequate packaging and ordinary wear and tear, scratches, cracks, etc., on suitcases or bags, if the utility value has not materially deteriorated,

j) indirect losses, including losses in connection with unauthorised use of traveller’s cheques, payment cards, mobile phones or the like.

20.4 How is the compensation calculated
a) Compensation for items documented (receipt, warranty, etc.) as being less than two years old is provided at the price of corresponding new items.

b) Compensation for items whose age and purchase price can be documented (receipt, warranty, etc.) and which are more than two years old is provided at the amount it would cost to repurchase the item less deduction for age, use, fashion, reduced utility and other circumstances.

c) Gouda is entitled to estimate the amount of compensation for items whose age and purchase price cannot be documented (receipt, warranty, etc.).

d) Gouda is entitled to provide compensation in kind, but is under no obligation to do so.

e) Gouda is entitled to have damaged items repaired or to pay out an amount to you that corresponds to the cost of having the item repaired.

f) Cover is only provided for loss of tape recordings (including videos), films, memory cards, scripts, drawings and the like at the value of the raw material.

20.5 Special conditions
Luggage lost while in the care of the transport company is considered lost at the earliest 30 days after the loss was reported to the transport company.

21. ACCIDENT

If your policy states that you have  taken out Supplementary Accident Cover, compensation is granted as stated below.

20.1 DISABILITY

21.1.1Expenses covered by the travel insurance
a) The travel insurance provides compensation for permanent injury that is a direct consequence of an accident if the accident caused a degree of permanent injury of at least 15%.

b) The compensation will amount to the percentage of the sum insured that corresponds to the degree of injury.

c) If you have not reached the age of 18 at the time the insurance takes effect, the sum insured will be adjusted in accordance with clause 21.2.2.

d) The degree of injury is determined according to the National Board of Industrial Injuries’ permanent injury rating list on the basis of the medical degree of injury. Your occupation will not be taken into account.

e) The amount of compensation will be determined as quickly as possible – but no later than three years after the accident.

f) It is a condition for cover that you are alive at the time the compensation is disbursed.

g) You can demand that the degree of injury be finally determined by the National Board of Industrial Injuries. The associated expenses are to be distributed evenly among the parties.

21.1.2Limit of cover
a) The combined degree of injury for loss of several limbs cannot exceed 100%.
b) Existing injuries will not lead to higher compensation than that which would have been paid had such injuries not existed.

a) an accident in case of no causality between the accident and the injury. Assessment is based on whether the incident is plausibel to cause permanent injury. The incident itself should be able to cause/explain the injury,
b) any illness including illness occuring as a result of infection with virus, bacteria, microorganism or the like,
c) injury or poisoning from food, beverages, stimulant including tobacco, alcohol and medicine,
d) an accident mainly caused by illness or any latent predisposition even though the illness has arisen by an accident. The policy neither provides cover for worsening of the consequences of an accident because of an already existing or accidental occuring illness,
e) consequences of erroneous medical treatment or other treatment including treatment with medicine unless the treatment was necessary in relation to an accident covered by the policy,
f) injury as a result of the insured participating in a fight/scuffle or the like or the insured participating in criminal activities,
g) injury due to bodily degeneration that cannot be defined as a sudden incident,
h) permanent disability as a result of psychological consequences of an incident in case the insured hasn´t been exposed to risk of personal injury,
i) incident as a consequence of childbirth,
j) expenses for dental treatment – please see section 21.3.

21.2 DEATH

Sum insured DKK 100.000

21.2.1Expenses covered by the travel insurance
The travel insurance pays the sum insured if you die during your trip as a direct consequence of an accident.

21.2.2Limit of cover
If you have not reached the age of 18 at the time the insurance takes effect, the sum insured in the event of death is reduced to DKK 25,000 kr. Any surplus amount relative to the table of clause 21.2 will be transferred to the accident sum insured of clause 21.1.

21.2.3Who will receive the sum insured
Unless otherwise agreed with Gouda, the compensation payable on death is disbursed in the following order of priority, i.e. a subordinate party will only receive compensation if the party prior to it does not exist/is not alive: Spouse, children, cohabiting partner or the insured’s heirs.

21.2.4The travel insurance does not cover
Exceptions mentioned in section 21.1.3 also applies in relation to death as a consequence of an accident.

21.3 DENTAL EMERGENCY

21.3.1Expenses covered by the travel insurance
Dental emergencies as a direct result of an accident are covered to the extent they are not covered by any other party. It is a condition for dental emergency cover that Gouda has approved the treatment in advance and that it is initiated as soon as possible after the accident.

21.3.2The travel insurance does not cover
The travel insurance does not cover

a) chewing-related dental emergencies, whatever the caused of the claim,

b) dental treatment expenses incurred later than three years after the accident,

c) damage to removable dentures.

21.4 ASSAULT

 Sum insured  DKK 200.000

21.4.1Expenses covered by the travel insurance
a) If you are the victim of deliberate assault resulting in personal injury during your trip, the travel insurance provides cover for the amount the perpetrator would be ordered to pay under the Danish Liability for Damages Act for assault committed under similar circumstances in Denmark.

b) It is a condition for cover that you are alive at the time compensation is disbursed.

21.4.2The travel insurance does not cover
The travel insurance does not cover

a) permanent injury or dental injury if such claims are covered under clauses 21.1 or 21.3,

b) assault committed by your travel companion, irrespective of whether he or she is covered under a Gouda travel insurance,

c) if, for no reasonable cause, you have exposed yourself to the risk of assault,

d) assault in connection with a criminal act committed by you,

e) damage to property.

21.5 GENERAL EXCEPTIONS TO ACCIDENT COVER
a) In case of accidents occurring in connection with air transport, compensation is exclusively provided for accidents affecting you as a passenger in aircraft displaying nationality codes.

b) Claims arising from any kind of skiing (including snowboarding and ski jumping) are not covered.

GENERAL CONDITIONS

22 THE INSURANCE CONTRACTS ACT (LOV OM FORSIKRINGSAFTALER) ALSO APPLIES TO THE TRAVEL INSURANCE
The provisions and exclusions stated below apply to this travel insurance in its entirety – clauses 1 - 21.

23 CONDITIONS FOR COVER
a) If you have reached the age of 70 at the time of departure and travel outside the EU/EEA, it is a condition for cover that you have applied for and obtained advance approval prior to each trip. You must therefore complete a health declaration to be submitted to Gouda.

b) You must be eligible for benefits under the Danish Health Act, including the public tourist health insurance, throughout the entire period of insurance.

c) The travel insurance must have been taken out and paid for prior to your departure from Denmark.

24 SCOPE OF COVER
a) The travel insurance only provides cover in the geographical territory stated in the policy.

b) Compensation is provided for insurance events arising during the period of insurance. If your return is delayed through no fault of your own, the period of insurance is extended without payment of additional premium by up to 14 days.

c) The insurance provides cover from the inception date stated on the policy provided the premium was paid prior to this date. The insurance is taken out for a period of one year and can be renewed by payment of premium for the next insurance year no later than one week before the renewal date, which is the same date as the inception date the following year.

25 GENERAL EXCLUSIONS
The travel insurance does not cover

a) claims arising from skiing, unless you have taken out Supplementary Ski Cover,

b) claims brought about by you through deliberate or gross negligence or under the influence of narcotics, medicine or other euphoriants, 

c) self-inflicted intoxication. This however does not apply section 1 Medical emergency, 2 Repatriation, 3 Assistance abroad – 24-hour medical emergency assistance, 4 Dental treatment and physiotherapy, etc., 6 Erroneous medical treatment, 7 Personal liability, 8 Legal assistance abroad and 10 Emergency reunion and escort.

d) claims arising in connection with your participation in scientific expeditions, during performance of professional sports or training,

e) indirect losses,

f) pilots and co-pilots during flights,

g) claims arising as direct or indirect consequence of: strike, lockout, attachment, sequestration or other public authority intervention, but see clauses 8.1 d and 9.1 b,

h) any expense after your return to Denmark, but see clause 5.3,

i) claims arising directly or indirectly as a result of war or warlike action, riot or civil commotion. However, the travel insurance covers such claims until the first given opportunity of evacuation, unless, even at the time of your entry into the area concerned, evacuation was recommended or effected due to existing commotion,

j) active participation in war, riot or the like,

k) claims arising directly or indirectly from nuclear energy or radioactive power release or radioactive fuel or waste radiation.

26 SUM INSURED
Unless otherwise specifically stated, the sums insured given for the individual types of cover and sub-covers constitute the maximum limit of Gouda’s liability to pay compensation for all claims arising under the individual types of cover during the term of the travel insurance.

Unless otherwise provided under the individual types of cover, the sums insured are stated per insured.

27 MISREPRESENTATION
It is important that information, including health details, provided to Gouda are accurate and correct. If information is concealed/withheld or incorrect answers are provided that may influence Gouda’s assessment, compensation may be reduced or will lapse altogether.

28 DOUBLE INSURANCE
The travel insurance does not cover claims for compensation covered by any other insurance. Compensation for disability and death under cover 20 Accident is not limited by other insurance taken out. Moreover, when making a claim you must always state whether you have taken out insurance with another company or if you hold a credit card. (This provision applies when the matter is settled according to Danish law.)

28A Insurance in other companies (Coinsurance). If, at the time the loss or damage insured by this certificate occurs, there is any other insurance against such loss or damage or any part thereof, the underwriter shall be liable under this certificate for its proportionate share of loss or damage only. (This provision applies when the matter is settled according to foreign law).

29 ASSIGNMENT OF CLAIMS FOR COMPENSATION
You may not pledge or assign your rights under this travel insurance without Gouda’s consent.

30 RIGHTS OF SUBROGATION
In the event of payments under this travel insurance, Gouda is subrogated to all your rights in that context. (This provision applies when the matter is settled according to Danish law.)

30A Rights of subrogation
The underwriter shall be fully and completely subrogated to the rights of the Insured against parties who may be liable to provide an indemnity or make a contribution with respect to any matter which is the subject of a claim under this certificate. The underwriter may at his own expense take over the Insured’s rights against third parties to the extent of his payment made. The Insured shall cooperate with the underwriter and provide such information and documentation reasonably required by the underwriter in order to collect and enforce his rights of subrogation. The underwriter may institute any proceedings at his own expense against such third parties in the name of the Insured. (This provision applies when the matter is settled according to foreign law).

31 RIGHT OF WITHDRAWAL
The following right of withdrawal applies to travel insurance policies whose period of cover exceeds one month:
a) You are entitled to a right of withdrawal under section 34 of the Danish Insurance Contracts Act (Lov om forsikringsaftaler).

b) The cooling-off period is 14 days. The period is calculated from the day on which you received/were sent the insurance conditions, but at the earliest from the time at which you were notified of the conclusion of the insurance contract. For example, if you receive the insurance conditions on Monday the 1st of a month, your cooling-off period extends up to and including Monday the 15th. If the cooling-off period expires on a public holiday, a Sunday, a Saturday or Constitution Day (5 June), you can wait until the following weekday.

c) Before expiry of the cooling-off period, you must notify Gouda that you have decided to withdraw from the contract. If you send notification by regular mail, you must send the letter before the expiry of the cooling-off period. If you want proof of timely withdrawal, you can send the letter as registered mail and keep the receipt.
You should send the letter notifying Gouda of your withdrawal to:

32 REIMBURSEMENT OF THE TRAVEL INSURANCE
a) If the insurance is terminated in writing before it expires, the balance of the premium payable for the reduced period of cover and the premium paid less a handling charge of DKK 100 per policy will be repaid. Amounts of DKK 100 and less are not repaid. The premium for the reduced period of cover is calculated according to Gouda’s price list for Single-Trip Travel Insurance with Superior Cover in the geographical territory concerned (EU/EEA, Extended Europe and Worldwide).

c) If the travel insurance has not come into force and Gouda receives notice of termination before the inception date, the full premium less a handling charge of DKK 100 will be reimbursed.

33 PRICE INDEXATION
Prices are indexed each year at the policy renewal date on the basis of the consumer-price index published by Danmarks Statistik for the month of September (development in prices relative to September the year before). If publication of the consumer-price index is discontinued, or if its calculation basis changes, Gouda is entitled to lay down new rules concerning future indexation.

34 CLAIMS
a) You must obtain and provide the information required for Gouda to decide whether the claim is covered and to which extent, that is, original police reports, third-party statements from e.g. travel agency guides, hotel staff or other relevant persons. See also section II – ”What to do if …”.

b) Gouda’s doctor is entitled to obtain information about your health and treatment from you own doctor as well as from other doctors or hospitals having treated you and if necessary discuss information received with these parties. Gouda guarantees strict confidentiality with respect to such information.

c) Gouda is entitled to demand that you submit to examination (including provision of blood samples) by Gouda’s doctor or a doctor appointed by Gouda. In connection with death, Gouda is entitled to demand an autopsy. In that case, Gouda will pay all the associated costs. If no autopsy is made despite Gouda’s request, the right to compensation may lapse.

d) You are under an obligation to submit original evidence of expenses or claims for which compensation is sought, including original purchase receipts, warranties, police reports, transport company reports, etc.

e) Transport options may be limited in countries at war or the like. Gouda is not responsible for the extent to which transport can be arranged, but in cases where assistance is needed, Gouda will cooperate with the Ministry of Foreign Affairs.

f) The maximum compensation for transport not arranged by Gouda amounts to the expenses Gouda would have incurred in arranging similar transport. However, the maximum amount payable is an amount equal to the price of a scheduled flight ticket – economy class as a maximum, but see clause 11.2 a.

g) Compensation will be paid immediately after Gouda has received the information considered necessary to establish Gouda’s liability to pay compensation.

h) After each notified claim you or Gouda may terminate the travel insurance at 14 days’ notice. In that case, termination must be made during the period from notification of the claim and until 14 days after payment or rejection of the claim. Gouda will not repay the premium neither wholly or partly if you terminate the insurance after inception according to this provision. If Gouda terminates the travel insurance, the premium is repaid, see clause 31 a.

35 COMPLAINTS BOARD
In the event of a disagreement between you and Gouda regarding the travel insurance and if renewed communication with Gouda does not lead to other outcome, you may file a complaint with:

36 VENUE
Legal proceedings against Gouda must be instituted before the Copenhagen City Court (Københavns Byret) or the Eastern High Court (Østre Landsret) in Copenhagen.

37 DEFINITIONS
In the following, we define the meaning of various expressions such as ”sudden illness” and “travel companion”. The definitions listed are the words given in italics in these conditions.

Accident
Bodily injury affecting you through a sudden, external incident. In connection with injury to your arms or legs, the only requirement is that the cause of injury is sudden and results in demonstrable injury to your body.

Accommodation expenses
Total expenses for hotel, meals, public transport and the like.

Additional expenses
Expenses exclusively reimbursed to you as a result of a claim covered under the insurance.

Aid
Object that may limit or remedy a physical ailment or handicap.

Artificial limbs and dentures
Artificial joints and limbs as well as dentures and artificial teeth.

Claim/Injury/Damage/Loss
A claim, an injury, damage or loss expresses a situation in which you intend to raise a claim against Gouda.

Cohabiting partner
A person with whom you live as a spouse and who was registered with the National Register of Persons as living at the same address as you at the time the insurance was effected.

Dispute
A specific and existing conflict which can reasonably form the basis of civil action.

Doctor/physician
A trained doctor/physician licensed by the authorities in the country in which you are staying who is not the insured person him- or herself, a relative of the insured or travelling with the insured.

Epidemic
A sudden, widespread outbreak of an infectious disease in a country or territory.

EU/EEA
Andorra, Azores, Belgium, Bulgaria, Cyprus, Estonia, Finland, France, Faroe Islands, Gibraltar, Greece, Greenland, Isle of Man, Ireland, Iceland, Italy, Canary Islands, Channel Islands, Latvia, Liechtenstein, Lithuania, Luxembourg, Madeira, Malta, Monaco, the Netherlands, Norway, Poland, Portugal, Rumania, San Marino, Switzerland, Slovakia, Slovenia, Spain, Great Britain, Sweden, the Czech Republic, Germany, Hungary, the Vatican City and Austria.

Extended Europe
The countries of the EU/EEA (see definition above) and the following countries: Albania, Algeria, Bosnia-Herzegovina, Egypt, Gaza, Belarus, Israel, Jordan, Yugoslavia (Serbia and Montenegro), Kosovo, Croatia, Macedonia, Morocco, Moldova, Lebanon, Libya, Palestine, Russia until the Urals, Syria, Tunisia, Turkey, Ukraine and the West Bank.

Foster children
A foster child is always registered with the National Register of Persons as living at the same address as you, and you have been approved by the local authority as provider of the child.

Foster parents
Persons who are not your biological parents or stepparents but who have been approved by the local authorities as your providers.

Gouda
Gouda Rejseforsikring (CVR No. 18 21 45 71), the Danish branch of Goudse Schadeverzekeringen N. V., Gouda, the Netherlands (Reg. No. 29012404).

Itinerary
Itinerary that can be documented through a travel plan from the travel agent, purchased plane, train or bus tickets or booked accommodation.

Month
Month means calendar month, which may lead to a different number of days, for example, 4 February to 3 March (28 days) and 26 May to 25 June (31 days).

Necessary expenses
Expenses that cannot reasonably be avoided. In cases where both local treatment and repatriation for further treatment in your home country are possible solutions, the travel insurance covers the solution that incurs the fewest expenses for Gouda.

Period of insurance
The period of insurance is stated in the policy. Insurance cover commences at the time when you leave your place of residence in Denmark to start your trip abroad and ceases on return to your residence, provided these times are within the period stated in the policy.

Price of the trip per day
Pre-booked travel services in respect of which a demand for payment can be made or paid, non-refundable expenses for transport, accommodation and other tourist-related payments, divided by the duration of the trip (the dates of both departure and return each count as one day). When travelling in your own vehicle, compensation at DKK 250 per day per person is paid – up to a maximum of DKK 1,000 per day per vehicle.

Professional sports
Performance of sports subject to contractual obligations towards a club, sponsor or the like, for which consideration or premiums are received. You are considered a professional athlete if in one of the five years preceding the period of insurance, your annual income in the form of consideration, premiums or sponsorships amounted to no less than DKK 100,000.

Return trip/Return(ing) to your home/Returning home
A trip back to Denmark that you can make as a healthy person on economy class.

Scientific expeditions
Expeditions to areas in which special residence permits are required by the local public authorities and for which you receive a consideration for participating.

Sudden illness
New illness, reasonable suspicion of new, serious illness or unexpected aggravation of a pre-existing or chronic illness.

Stepchildren
Children who are not your biological children when you are married to or the cohabiting partner of one of the child’s biological parents and with whom you have lived in a family-like relationship for at least one year.

Stepparents
Persons who are not your biological parents but who are married to or the cohabiting partner of one of the biological parents and with whom you have lived in a family-like relationship for at least one year; alternatively, a person who has lived with one of your biological parents for at least two years.

Stepsiblings
Persons who are not your biological siblings but with whom you live or have lived in a sibling-like relationship for a period of at least one year until you 21st birthday.

Terrorism
An act of violence or threatened act of violence which, by spreading fear among the civilian population, seeks to exert pressure on the authorities to meet religious or political objectives.

Travel companion
One or more persons having purchased the same trip as you and covered by a Gouda travel insurance.
